Case No.156 of 2021, which is pending before the learned Additional Chief Judicial Magistrate at Barrackpore, North 24 Parganas. Records reveal that charge sheet has been submitted by the investigating agency on conclusion of investigation. However, no documents under Section 207 of the Criminal Procedure Code are enclosed and the learned advocate for the petitioner submits that till date she has not received documents.

Having considered the same, I am of the view that the petitioner would be at liberty to take up the issues at the stage of Section 239 of the Criminal Procedure Code before the learned Additional Chief Judicial Magistrate after receipt of the documents under Section 207 of the Criminal Procedure Code. The learned Magistrate is requested to consider the same independently without being influenced by any observations made by this Court in this revisional application.

With the aforesaid observations, CRR 980 of 2024 is disposed of.
