The petitioner's husband died-in-harness on July 11, 2018 working as a Sweeper at the Malda Regional Office of Bangiya Gramin Vikash Bank (BGVB). The petitioner has prayed for compassionate appointment. The family pension of Rs.4,000/- received by the petitioner per month is not enough for sustenance of the petitioner along with two minor children.

Mr. Chakravorti, learned counsel appears on behalf of the petitioner.

Mr. Ghosal, learned counsel appearing on behalf of BGVB submits that an application needs to be submitted in proper form for consideration of the prayer of the petitioner pursuant to the 2019 scheme.

In the event an application is made in the proper form within a period of 2 weeks from date, the same shall be considered by the officer concerned of the respondent bank/BGVB within a period of 6 weeks therefrom upon giving a personal hearing to the petitioner. The said representation/application will be disposed of by a reasoned order, which shall be communicated to the petitioner within 2 weeks of passing thereof.

With the directions aforesaid, WPA 6148 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the writ petition, the allegations contained therein are deemed not to have been admitted by the respondents.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
