In pursuance of the direction passed by this Court dated 22.04.2024, the SI of Police, Kotwali PS, District - Cooch Behar submitted a report stating that the appellant, namely, Nabagopal Basak has already been expired during the pendency of this appeal on 01.09.2012. A photocopy of Certificate of Death of that appellant is annexed with the report.

As the sole appellant has already expired, the instant appeal stands abated against him.

Accordingly, the appeal being CRA 347 of 1991 stands disposed of as abated.
