Petitioner submits that she would produce the requisite documents before the Inspector-in-Charge, Arambagh police station supporting her contention relating to encroachment of land as also the encroachment of the PWD properties. Petitioner has already made a representation.

Police authorities have sent a notice for approaching them at any working day. In case the petitioner approaches with the documents she intends to submit in support of her contention to the information/representation earlier submitted on 05.03.2025, the same be received and dealt with in accordance with law.

Learned advocate for the private respondent submits that at no point of time the respondents either

received any money or has encroached upon the land of the petitioner or the land of PWD. However, it has been admitted on behalf of the respondents that a fair is usually held wherein stalls are constructed but the respondents have never constructed such stalls at the land of the petitioner.

Learned advocate for the petitioner opposes such contentions and submits that there is an intention of the private respondents to encroach the land, to that effect they have documents in their custody.

Report has been submitted and the police authorities are willing to take steps in accordance with law.

As such petitioner would be at liberty to approach the Inspector-in-Charge, Arambagh Police Station who would depute an Officer of his choice for conducting an enquiry for dissuading the apprehension of the petitioner regarding the encroachment, if any, on her land. The police authorities would also ensure that there is no breach of the peace and/or tranquility and/or any untoward incidents resulting because of the nature of the dispute complained of.

With the aforesaid observations WPA 6006 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the notice which was sent by the Inspector-in-Charge, Arambagh Police Station be handed over to the learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
