The petitioner in this case is the accused who has prayed for setting aside the order of retrial passed by the learned Sessions Court in a case of acquittal. Subsequently, retrial was conducted and the accused/petitioner has been found guilty. It is now submitted by the learned counsel for the petitioner/accused that an appeal against the said conviction on retrial being Criminal Appeal No. 31 of 2023 is pending before the learned Sessions Judge.

As the present revision was filed prior to the retrial, the same has now become infructuous.

Accordingly, the present revisonal application is disposed of as infructuous.

All connected applications, if any, stands disposed of. Interim order, if any, stands vacated.

Let a copy of the order be sent to the learned trial court for compliance.

Learned counsel for the State to inform the status of this case to the concerned authority.
