1. Ms. Afreen Begum, learned advocate for the petitioner, Mr. Anil Kr. Gupta, learned advocate for the UGC, Mr. Loknath Chatterjee, learned advocate for the respondent nos.4 to 6 and Mr. Subir Sanya, learned senior advocate for the respondent no.7 are present.

2. Affidavit-in-opposition filed on behalf of the University Grants Commission is taken on record.

3. Learned counsel for the petitioner at the outset fairly submits that the petitioner filed this petition in the year 2022, when respondent no.7 was occupying the post in question. Now he has attained the age of superannuation and retired on 22nd March, 2023.

4. Thus, in the opinion of this court no useful purpose would be served in keeping this PIL pending. Even otherwise, the prayer is in the nature of issuance of writ of quo warranto, which

cannot be entertained in the PIL. The petitioner has not prayed for any relief for recovery of remuneration paid to the respondent no.7. For these cumulative reasons, the PIL is dismissed. (Sujoy Paul, J.) (Smita Das De, J.)
