Report submitted by the learned advocate appearing for the State be kept with the record.

Records reflect that on 18th April, 2023 in connection with Joynagar Police Station Case No.22 of 2017 warrant of arrest has been issued against the present petitioner. The report which has been submitted do not reflect that the warrant of arrest has till date been executed or not.

Learned advocate appearing for the petitioner submits that the petitioner was earlier on bail and subsequently due to nonappearance, warrant of arrest has been issued against him. In view of the submission so advanced on behalf of the learned advocate appearing for the petitioner as also that of the State, I am of the view that an opportunity must be granted to the petitioner. Accordingly, if the petitioner appears and/or surrenders before the learned ACJM, Baruipur by 25th April, 2024 and the learned ACJM on inspection of the records finds that the petitioner

was earlier on bail, the learned ACJM would allow the petitioner to continue on the same bail and bond subject to the conditions that he would meet with the Inspector-in-Charge/Officer-in-Charge, Joynagar Police Station once in a fortnight till the commitment is over.

The warrant of arrest so issued be stayed till 25th April, 2024.

In case the petitioner do not appear or surrender before the learned ACJM, Baruipur on or before 25th April, 2024, on 26th April, 2024, it would be the discretion of the learned ACJM, Baruipur to issue harsher process of law and ensure execution of the same as early as possible.

With the aforesaid observations, CRR 986 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
