The mother of the petitioner was an employee of the ICDS, West Bengal and died in service on 17.10.2016. Certain medical bills were submitted on account of the deceased mother to the employer whereupon by letter dated 5th September, 2017, the Director of ICDS, West Bengal asked for the succession certificate from the petitioner. The said succession certificate issued by the learned Civil Judge (Senior Division), Balurghat, Dakshin Dinajpur dated 26th November, 2018 was duly submitted and yet the Director of ICDS, West Bengal has not taken any decision in that regard.

In the above circumstances, the Director, Directorate of Integrated Child Development Service (ICDS), West Bengal namely, the respondent no.4 herein shall take a decision on the petitioner's claim for medical reimbursement to the extent of the bills submitted and not paid by the ICDS till date, within a period of one month from the date of receipt of a copy of this order. The petitioner and/or her legal representative shall be entitled to be heard by the Director of ICDS, West Bengal in this regard.

A reasoned order may be passed.

If the Director of ICDS, West Bengal is satisfied with the claim of the petitioner, the same may be disbursed within a period of one month from the date of the order that will be passed by the respondent no.4 herein.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

Urgent xerox certified copy of this order, if applied for, be given to the parties on usual undertaking.
