Md. Anwar Hossain Ms. Sreyashee Biswas .... For the State Learned counsel appearing on behalf of the petitioner submits that petitioner would not like to press this application and would instead pray for a direction for expeditious disposal of the trial. Let a copy of the revisional application be served upon Md. Anwar Hossain and Ms. Sreyashee Biswas learned counsels who ordinarily appear on behalf of the State. They are requested to appear in this matter. Their engagement may be regularised by the competent authority of the State in due course.

Learned counsel appearing on behalf of the petitioner submits as follows. The impugned proceeding has been pending since 2013. The prime witness to the case has not appeared despite issuance of witness warrant. Only two witnesses are to be examined apart from nonappearing witness. The trial has remained pending for no fault on the part of the petitioner.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition.

No prejudice would be caused to any one if a direction is passed for an expeditious disposal of the case.

It appears that some delay was occasioned in disposing of the impugned proceeding, regardless of who was actually responsible for the same.

On the prayer of the learned counsel appearing on behalf of the petitioner, the prayer for quashing of the proceeding is dismissed as not pressed.

However, the learned Trial Court is requested to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties preferably within a period of six months from the next date of hearing. The learned Trial Court shall also be at liberty to take appropriate measures for securing attendance of the witnesses.

With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, is to be given to the parties upon usual undertakings. (Jay Sengupta, J.)
