1. Affidavit-of-service filed in Court today be taken on record.

2. The petitioner participated in the recruitment process to the post of Assistant Teacher advertised on 29th September, 2022 as a B.Ed. Trained candidate. She acquired her D.El.Ed. qualification in December, 2022 for the course period 2020-22.

3. She could therefore be termed as an in course D.El.Ed. as well.

4. Mr. Saikat Banerjee, learned Counsel appearing on behalf of the West Bengal Board of Primary Education submits that the petitioner had the option, at the time of applying as well as at the time of editing her option, to change her basic qualification from B. Ed. to D.El.Ed. She did not.

5. This Court has earlier delivered judgments permitting the petitioners, who could not change their basic qualifications from B. Ed. and D.El.Ed., NIOS to D.El.Ed. Regular Course and participate in the subject recruitment process.

6. In W.P.A. No. 5598 of 2024 dated 4th March, 2024, this Court had also permitted the in-course D.El.Ed. candidates as on the date of Notification i.e. 29th September, 2022 to participate in the ongoing interview process, for the reasons mentioned therein.

7. In that view of the matter, the petitioner shall be called for interview by the Board within 7th March, 2024 or any extended date that the Board may choose to include the petitioner within 2100 and odd candidates for interview.

8. Needless to mention the right and interest of the petitioner in the subject recruitment process shall abide by the final decision of the Hon'ble Supreme Court of India in S.L.P. (Civil) No. 12660 of 2023.

9. With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
