Being aggrieved by the inordinate delay in disposal of the interim maintenance application, learned counsel for the petitioner submits that the petitioner and her minor child are in dire need of financial support but this protracted delay in disposal of the said application is violative of the petitioner's right to live. Therefore, he sought for appropriate direction upon the Court below.
Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and as such, service of copy of application upon the opposite party is dispensed with.
Having considered the submission made on behalf of the petitioner and that the petitioner's prayer for interim maintenance is pending for disposal for a considerable period of time, the instant application being CRR 1200 of 2026 is hereby disposed of with a direction upon the Court below to dispose of the petitioner's prayer
for interim maintenance application on the next date, that is, on 07.08.2026 or within a period of two weeks thereafter. This order is invoking this Court's jurisdiction under Section 429 of the BNSS.
