Learned advocate appearing for the petitioner submits that the petitioner is innocent and falsely implicated in connection with the instant case. Further, petitioner is in custody since 9th April, 2025, charge-sheet has been submitted in the month of June, 2025 and there is no possibility of the trial commencing in near future as two of the accused persons are absconding. Learned advocate for the State opposes the prayer for bail.

Having considered the time period which has passed since the petitioner was arrested, I direct the learned trial court to

exhaust the process of law and split up the trial, if required, thereafter overcome the stage of consideration of charges. I have taken into account the subject matter of the case. Prima facie, it reflects from the records that the petitioner is owner of the property where the alleged offences took place. Having considered the same, it would be premature to comment on the culpability of the present petitioner. As such, the prayer for bail of the petitioner in CRM(M)718 of the 2026 is rejected. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
