W.P.A. 4907 of 2020 (Keshab Ch. Giri vs. State of West Bengal & Ors.) Mr. Bhaskar Manna .... For the Petitioner Mr. C. C. De Mr. Anirban Sarkar .... For the State The grievance of the petitioner pertains to unlawful illegal acquisition of the subject premises.

It is submitted on behalf of the petitioner that his land has been taken over by the Public Health Department, Government of West Bengal way back in the year 2012 for construction of water reservoir but no compensation has been paid to the petitioner. Mr. De, appearing on behalf of the State files a status report and submits that a proposal for permission for direct purchase of the land of the petitioner was submitted to the Superintending Engineer, Western Circle office by the Executive Engineer, Tamluk Division, PHE directorate, vide his office memo no. 1464/TD dated 14th November, 2013 and the same was forwarded to the Chief Engineer, Western Zone by the Superintending Engineer, Western Circle vide his office memo no. 1385/WC, dated 20th November, 2013. It is further submitted on behalf of the State respondents that the proposal has been forwarded to the Special Secretary, PHE Department by the Chief Engineer vide office memo no 22040/79/D/11 dated 25th November, 2013. However, no final

purchase has been made till date nor has any compensation been paid to the petitioner.

In view of the submissions made on behalf of the parties and more particularly in view of the submissions of the State though a proposal for permission for direct purchase of the subject premises has already been initiated, W.P.A. 4907 of 2020 is disposed of by directing the respondent No. 2 to take steps for completion of the purchase of the petitioner's land in accordance with law within a period of four months from date.

There shall be no order as to costs.
