Subal Chandra Paul v. State Of West Bengal & ORS
12.
28.01.2021 mb In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A. No. 4908 of 2020 (Via Video Conference) Subal Chandra Paul -Vs.- The State of West Bengal & Ors.
Mr. Ambu Bindu Chakraborty, Ms. Mrinmoyee Roy Chowdhury ...for the petitioner Mr. Samrat Sen, Ms. Amrita Panja ...for the respondent-authorities The present writ petition has been filed by the petitioner on the allegation that, despite the petitioner being a senior citizen, the private respondents, being his son and daughter-in-law, ill-behave with the petitioner and abuse and harass the petitioner in various manners.
Learned counsel for the petitioner seeks police assistance to redress such grievance. It is submitted that, despite complaint being lodged with the police, nothing was done in that regard. Unfortunately, although such ill-behaviour, if any, can take the shape of a social malady, there is no legal redress available to the petitioner, which can be mitigated by the police,
unless an unlawful act is perpetrated against the petitioner. In the present circumstances, there is no scope for passing any direction on the policeauthorities. Accordingly, W.P.A. No. 4908 of 2020 is disposed of by granting the petitioner the liberty to approach the police-authorities in the event any specific act is committed by the private respondents against the petitioner in derogation of legal provisions.
If so approached, the police shall render all possible assistance in that regard.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
