Das ... for the Petitioner(s) Ms. Jhuma Chakraborty Ms. Sangeeta Roy ... for the State-respondent(s) The petitioner claims that although he is having all the documents including the licence for operating Restaurant-cumBar, he has been obstructed to carry on the said business because of interference of the local miscreants. To that effect, an information was furnished with the police authorities, but, in spite of the same, the petitioner apprehends further repetition of the earlier incidents.

Learned advocate for the State has submitted a report which reflects that pursuant to the information furnished

earlier, the police authorities registered a specific case and charge-sheet was also submitted.

Since the petitioner's contention is that he is having appropriate licence for carrying on the said Restaurant-cum-Bar, the police authorities if they are satisfied that such documents are in the possession of the petitioner, they would ensure that the petitioner is able to run his business without any external interferences.

The petitioner is directed to approach the Officer-in-charge of Magrahat Police Station who would check the documents, thereafter, take necessary steps.

In case, the police authorities are of the opinion that they apprehend crisis in public law and order situation because of the running of such business, the police authorities cannot take the law in

their own hands as licence has been granted by the Excise Authorities. The police authorities, in such circumstances, would apply to the Excise Authorities for taking necessary steps in regard to the licence concerned.

With the aforesaid observations, WPA 6658 of 2024 is disposed of.
