Versus

The State of West Bengal & Ors.

Petitioner complains that the keys of the residential house of the petitioner as well as the room of the Secretary of Al-Islamia Mission Academy be returned to her.

State has submitted a report which states as follows :- "That, in course of investigation of this case, the investigation agency only seized one manually maintained Hostel register Book and one DVR of the CCTV of Al-Islamia Mission Academy as produced by the school teacher-in-charge Azmira Khatun. No such key of the house of the petitioner as well as the Secretary room of said Al-Islamia Mission Academy, did not took away/seized/confiscated by the investigation agency.

Only the above mentioned articles were seized from said

school teacher-in-charge Azmira Khatun of Al-Islamia Mission Academy, that too under proper videography in accordance with the Law.

Thus, the petition which was lodged by the instant petitioner regarding unlawfully seized/confiscated/taken away the key (s) of the residential house of the petitioner as well as the room of the Secretary of Al-Islamia Mission Academy, is fabricated and not substantiate."

In view of the stand of the State that the keys of the said Al-Islamia Mission Academy or the house of the petitioner or the Secretary's room were never affixed with a padlock and were neither sealed, I am of the view that if there are any padlock affixed at the behest of the police authorities in connection with Labpur PS Case No. 152/24 dated 06.09.2024, the petitioner would break open the padlock and enter the said room in view of the specific stand taken by the State before this Court.

With the aforesaid observations WPA 6019 of 2025 is disposed of.
