Galib Mr. Subhra Nag .... for the State The present writ petition has been preferred praying for a writ of mandamus directing the concerned respondents to grant financial assistance to the petitioners to enable them to construct their dwelling houses under the scheme, namely, "Bangla Abas Yojana" (hereinafter referred to as the " Scheme"). Mr. Bera, learned Advocate representing the petitioners, submits that the petitioners' houses were destroyed by a cyclone. Following that incident, the petitioners approached the concerned respondents seeking financial assistance to reconstruct their dwelling houses under the Scheme.
The record reveals that a number of persons, claiming to be identically circumstanced, submitted a
joint petition before the District Magistrate, Alipore, South 24-Parganas.
Mr. Bera informs the Court that subsequently all the petitioners made individual applications highlighting their grievances.
In view thereof, the writ petition is disposed of by directing the District Magistrate, Alipore, South 24Parganas, to consider the individual applications presented by the petitioners and decide whether the petitioners' contentions deserve acceptance.
It is clarified that if the concerned District Magistrate finds that the petitioners' contentions deserve acceptance, appropriate follow-up steps shall be taken. This may include the grant of financial assistance under the said Scheme introduced for that purpose. If the concerned District Magistrate finds that the petitioners' contentions lack merit and/or no such Scheme is available, a reasoned order shall be passed and communicated to the petitioners. The concerned District Magistrate may undertake the responsibility to consider and dispose of the individual applications himself or may depute a suitable officer from his establishment to do so.
However, the entire exercise shall be carried out within a period of twelve weeks from the date of receipt of a copy of this order.
With these observations and order, the writ petition is, thus, disposed of.
There shall be no order as to costs.
