Mr. Monoranjan Jana ..for the petitioner Mr. Suddhadev Adak ..for the State Mr. Koushik Dey Mr. Dip Jyoti Chakraborty Mr. Chitrak Biswas ..for the intervenor Mr. Dey, learned advocate for the complainant submits that his client has not been impleaded as party respondent in this writ petition though the petitioner has prayed for an order directing the police authorities to render necessary assistance for demolition and for removing the structure on the PWD land.

It appears from the materials on record that this Court by an order dated 4th February, 2026 in WPA 2277 of 2026 directed the appellate authority to take up the hearing of the appeal under Section 10(4) of the 1964 Act on March 11, 2026.

It has been uniformly submitted by Mr. Jana, learned advocate for the petitioner and Mr. Dey, learned advocate for the complainant that the hearing took place before the appellate authority on 11th March, 2026. Mr.

Dey submits that no order has been communicated to his client till date.

Mr. Jana, learned advocate appearing for the petitioner submits that an order has already been passed but he could not produce any copy of the order passed by the appellate authority.

The State is represented by its learned advocate. Thus it appears that the writ petition is a premature one.

Faced with such situation, Mr. Jana, learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to file at the appropriate stage.

In the light of the submissions made by Mr. Jana, learned advocate for the petitioner, WPA 6289 of 2026 stands dismissed as withdrawn with the liberty as sought for by the learned advocate for the petitioner. (Hiranmay Bhattacharyya, J.)
