The petitioner is the plaintiff in Money Suit No.359 of 2019. The petitioner prays for expeditious disposal of the said suit.

It is the contention of the petitioner that an application is pending before the learned Judge, VIIth Bench City Civil Court at Calcutta since March 3, 2020 for necessary direction to enable the petitioner/plaintiff to take back the summons so that the same may be served upon the defendants in the suit. It is submitted that all requisites have been filed but the summons have not yet been served despite several attempts.

Under such circumstances, this revisional application is disposed of with a direction upon the learned court below to hear out the pending application dated March 3, 2020. The learned court below will dispose of the said application within a period of two weeks from the next date fixed. This Court has not gone into the merits of the application and the same be decided by the learned court

below independently and on its own merits. There is no observation made with regard to the fate of the application either.

The petitioner is directed to serve copies of this revisional application along with a server copy of this order upon the opposite parties within a week from date. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
