The writ petition cannot be entertained on the basis of the prayers made therein.

The petitioner alleges that the respondent no.5 has kept a rolling shutter in a locked position which has prevented the CESC authorities from taking proper meter reading. The consumption of the petitioner had not been properly mentioned in the bills raised.

The learned advocate for the CESC Limited submits on instruction, that there was no resistance with regard to access to the meter board. That regular bills are being raised and the petitioner is not being issued average bills. The petitioner has also not been able to justify how the writ is maintainable against the CESC authorities. The petitioner has not been able to show that average bills have been raised. It is also not the case of the petitioner that

exorbitant bills have been raised without proper meter reading.

It appears from the sum and substance of the pleadings that the petitioner is aggrieved by the action of the respondent no.5 who has allegedly kept a portion of the house under lock and key. It is also a matter of record that a civil litigation is pending between the parties.

Thus, the writ petition is disposed of without any order.

Needless to mention that the CESC shall continue to raise bills as per the meter reading.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
