The subject-matter of challenge of the present appeal is against an order of acquittal passed by learned Judicial Magistrate, 3rd Court, Barrackpore. Records reflect that earlier on 26.03.2019, none represented the appellant when the appeal was called. As the appeal is against an order of acquittal and there is reluctance on the part of the de facto complainant to pursue the appeal, I am of the view that no purpose would be served by keeping the appeal pending. Accordingly, the appeal being CRA 169 of 2019 is dismissed for default.
