1. The petitioner says that he is in custody for about 1 year. 2 other accused persons have been granted statutory bail since the FSL report was not available. He says that circumstances prevented him from applying for statutory bail but otherwise he stands on the same footing as the other two persons who have been granted statutory bail. He prays for bail on merits.

2. We find that 3 out of 15 chargesheet named witnesses have already been examined by the prosecution. Therefore, there is no inordinate delay in progress of the trial. Commercial quantity of narcotics is involved in this matter. In view of the restriction in Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner, at this stage.

3. CRM (NDPS) 341 of 2025 is dismissed.
