Learned counsel for the petitioner submits that the FIR has been lodged after an inordinate delay. The victim is a married lady and was in consensual relationship with the petitioner.
Opposing the prayer, learned counsel for the State refers to the statement of the victim under Section 164 of the Code of Criminal Procedure.
I have considered the material on record. The statement of the victim recorded under Section 164 of the Code of Criminal Procedure implicates the petitioner. The petitioner claims to be a police personnel.
The case is yet to be committed. At this stage in the event the petitioner is released on bail, likelihood of his tampering
with evidence, intimidating witnesses and winning over witnesses cannot be ruled out.
In view of the above, the prayer for bail is rejected at this stage.
The application for bail is disposed of.
