The appointment letter has been issued in favour of the applicant. A copy of the same is taken on record. Mr. Shaw, learned advocate appearing for the applicant, contends that the approval for appointment has been issued with effect from the date of joining pursuant to the appointment letter and not from the date of the order passed by this Court. According to him, the right of the applicant crystallized when the order was passed by the Single Bench in her favour. Only because the matter had travelled upto the Hon'ble Division Bench and the Hon'ble Apex Court at the instance of the respondents, the time spent in the litigation at the instance of the respondents

should not be a deterrent to the right of the petitioner to be appointed on the basis of the order of the Single Bench. This Court is of the view that although the issue raised by Mr. Shaw has merit, the same has to be adjudicated in a proper proceeding before the appropriate forum. The applicant is at liberty to take such steps. Accordingly, the contempt application is disposed of and the contempt proceedings are dropped. The Rule is discharged.
