... for the respondent This writ petition is directed against the order dated November 20, 2019 passed in OA No. 420 of 2017 in which the learned Tribunal in considering the prayer for the applicant for payment of interest on the arrear salary after fixation of pay during the period June 29, 1985 to May 31, 2010 disposed of the said application directing the SubDivisional Land & Land Reforms Officer, Chanchal, DistrictMalda, to pay to the applicant the interest @ 8% per annum on the amount of Rs.1,27,900/- during the period from December 1, 2011 to February 28, 2019 within a period of 12 (twelve) weeks from the date of communication of the order. It is an admitted position that during the aforesaid period the arrear salary to the tune of Rs.1,27,900/- was not paid to the petitioner.

Having regard to the fact that the petitioner was deprived of the said sum of money illegally and arbitrarily, we do not find any reason to interfere with the discretion of the learned

Tribunal in awarding interest for the aforesaid period @ 8% per annum. This application, being WPST 28 of 2021 fails and the same is accordingly dismissed. However, there shall be no order as to costs.
