The allegation is that the canal in front of the petitioner's house was filled up, resulting in overflow of filthy water.

It is submitted that unless the canal is cleaned up by removing the silt and garbage, the area will be inundated. Stagnation of dirty water would cause diseases. It is further submitted that a new drain is being constructed by the authorities. Hence, a prayer is made that the drain must be constructed in a way that water logging in front of the petitioner's house can be avoided.

This Court is not in a position to enter into the correctness of the allegations made by the petitioner. The gram panchayat is not present before this Court. The petitioner has already approached the Pradhan of the Baharamuri Gram Panchayat and the

Block Development Officer, Hirbandh Block, with his grievance.

The concerned authorities, namely, the Block Development Officer, Hirbandh Block and the Pradhan of the Baharamuri Gram Panchayat shall cause an inspection of the area in question.

Maintenance of sanitation, and waterways etc. are within the jurisdiction of the gram panchayat. It is expected that the authorities shall take steps to avoid water logging. Proper sanitation must be maintained, so that the people in the locality can live in a clean and pure environment. An inspection shall be made in presence of the petitioner and all other inhabitants of the locality.

It is expected that all efforts shall be made by the authority to preserve cleanliness and sanitation of the area, especially in an around the canal in front of the petitioner's house.

Steps in this regard shall be taken within a period of two months from the date of communication of this order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
