Heard learned counsels for the parties.
The petitioners are in custody for more than 200 days and pray for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record.
The victim is the wife of the 1st petitioner and the 2nd petitioner is her mother in law. There are allegations of torture against the petitioners.
The primary cause of the victim's death has been stated to be negligence by the petitioners. The post mortem report does not detect any external injury on the person of the victim. Charge sheet has been submitted. The prosecution proposes to examine 17 witnesses. Possibility of conclusion of trial in the near future is bleak.
Considering the nature of offence and extent of complicity of the petitioners therein, prayer for bail is allowed.
The petitioners Sadhan Bauri & Sabitri Bauri be released on bail upon furnishing bond of Rs.10,000/- each (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Khatra, Bankura subject to condition that they shall appear before the learned trial Court on every date of hearing. They shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioners fail to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court. The application for bail is thus disposed of. Case Diary be returned.
