Learned advocate representing the State respondents has obtained instruction from the District Inspector of Schools (S.E.), Kolkata that the dues of the petitioner i.e. 33% share in the gratuity amount has been disbursed in his favour.

Learned advocate for the petitioner admits that his client received the subject payment.

The petitioner has alleged that the private respondent i.e. the respondent no. 4 has cheated him and transferred certain amounts from his personal bank account in her own name. Complaint was lodged before

the Officer-in-Charge, Jadavpur Police Station but no step is alleged to be taken.

From the report filed by the police signed on March 12, 2024 it appears that the police did not take any steps in response to the allegation of cheating. The petitioner is an octogenarian. At this age his savings will presumably be required for his treatment and for his survival. The daughter-in-law of the petitioner ought not to have transferred the amount from the bank account of the petitioner, as alleged. The petitioner has mentioned that he is bedridden and he cannot afford the basic medicines required to stay alive.

The police is directed to take necessary steps for redressal of the grievances of the petitioner. The writ petition stands disposed of.
