The petitioner no.1 is claiming to be an All India Organization of the members of the Scheduled Castes and Scheduled Tribes Community and the rest are the guardians of some of the students of the Tutranga Anchal Siksha Niketan School (H.S.), Belda, District: Paschim Medinipur. The petitioner no. 1 on May 08, 2021, has made a representation before the District Magistrate, Paschim Medinipur, the respondent no. 3 herein wherein different allegations including the allegation of misappropriation of the school funds has been made against the Headmaster of the aforementioned school, the respondent no. 8 herein. The petitioners are praying inter alia, disposal of their said representation.
Mr. Ganguly, learned advocate for the West Bengal Board of Secondary Education submits that the Board, being
the disciplinary authority of the respondent no. 8 has written a letter to the respondent no. 3 on September 22, 2023 to conduct an enquiry into the allegations of the petitioners against the respondent no. 8 and to file a detailed report before the Board, reminder letters have also been issued to the respondent no. 3 and the Board, after receipt of the said report, shall take appropriate steps.
Copy of the said letter dated September 22, 2023 is taken on record.
The grievance of the petitioners has been addressed since the appropriate authority has directed enquiry into the allegations.
Mr. Ghosh, learned advocate for the respondent no. 8, submits that the exception to the report filed by the District Inspector of Schools (SE), Paschim Medinipur, the respondent no. 6 herein though is ready but he is unable to file the same as it is not readily available with him. Be that as it may the allegations in the said report against the respondent no. 8, if there be any, are deemed to have been denied by him.
WPA 5847 of 2022 is thus disposed of without any order as to costs.
