A calculation sheet signed by the Chairman, Murshidabad Municipality on December 29, 2023 has been placed before this Court.

Learned advocate appearing for the petitioner submits that out of the interest that has been calculated i.e. Rs. 2,38,678/-, a sum of Rs. 50,000/- has been paid. The rest is due and payable to the petitioner.

Learned advocate representing the Municipality has made a written communication to the learned advocate representing the petitioner vide communicating letter dated January 2, 2024 intimating that the balance amount will be disbursed in favour of the petitioner as and when fund will be made available from the Government and in any event within six months the payment will be completed.

The learned advocate of the Municipality submits that the aforesaid time limit has been mentioned in the

communicating letter upon specific instructions given by the Chairman of the Municipality.

Relying upon the aforesaid assurance given by the learned advocate representing the Municipality, the writ petition stands disposed of.

The Municipality shall act in accordance with the assurance given in Court and clear all payments by June 30, 2024.

The writ petition stands disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
