Learned Counsel appearing for the petitioner submits that a representation dated 14th January, 2020 has been made before the Managing Director, West Bengal State Warehousing Corporation being the respondent no. 3 in the instant application but such representation has not been considered by the Managing Director, West Bengal State Warehousing Corporation being the respondent no. 3 in the application till date. Learned Counsel appearing for the West Bengal State Warehousing Corporation Limited is present. Heard both the parties.

The Managing Director, West Bengal State Warehousing Corporation being the respondent no. 3 is requested to consider the representation of the petitioner dated 14th January, 2020. The writ petitioner is also directed to serve a copy of this order along with the writ

petition to the Managing Director, West Bengal State Warehousing Corporation being the respondent no. 3. The Managing Director, West Bengal State Warehousing Corporation being the respondent no. 3 is requested to give an opportunity of hearing to the petitioner and to allow the petitioner to produce all the relevant documents at the time of hearing and pass a reasoned order within six weeks from the date of communication of this order. The Managing Director, West Bengal State Warehousing Corporation being the respondent no. 3 is also requested to communicate the reasoned order to the petitioner at an earliest.

The writ petition being W.P.A. 7007 of 2021 is accordingly disposed of.

There will be no order as to costs.

I make it clear that I have not gone into the merits of the writ petition, all the issues are left open to the respondent no.3 to be decided by him.

Since no affidavits have been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

Urgent certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
