Nobody appears on behalf of either of the parties on call. Even on earlier occasion no one represented the petitioner, no accommodation sought for.

This is an application filed under section 482 of the Criminal Procedure Code, 1973 seeking quashing of the proceeding of CR Case no. 1185 of 2017 under sections 406/420/418/506/120B of the IPC, 1860 pending before the learned Judicial Magistrate, 4th Court at Siliguri including the orders passed therein.

However, no one represented the petitioner, no accommodation sought for in spite of giving several opportunities.

In view of the aforesaid facts it seems the petitioner has no more interest to proceed with the instant case. Accordingly, CRR 787 of 2018 is dismissed for default.

Interim order, if any, stands vacated.

Let a copy of this order be communicated to the learned court below immediately for information.
