In this revisional application an order was obtained by the petitioner on April 18, 2007 wherein a coordinate Bench of this Hon'ble Court had directed calling for lower court records. Subsequently, no movement has taken place in this matter whatsoever. When the matter was called on July 7, 2021, Mr. Kallol Mondal, Counsel appearing on behalf of the petitioner had sought for three weeks time which was granted. Thereafter, on July 22, 2021 a further three weeks time was granted on the request of the petitioner when the matter was fixed on August 12, 2021.

Today, when the matter has been called on, none has appeared on behalf of the petitioner.

In my view, the petitioner is not interested in pursuing this revisional application in relation to an order passed under Section 125 of the Code of Criminal Procedure.

< Accordingly, this revisional application is dismissed for default and connected applications, if any, are also dismissed. Interim order, if any, stands vacated.

The department concerned is directed to communicate the order passed in Court today to the Court below. The department shall ensure that acknowledgement of receipt of their communication is received. Report of compliance to be placed before this Court after three weeks.

The lower Court is directed to expeditiously act in accordance with law.
