Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner apprehends that he may be dispossessed by the private respondent no.4 who, according to the petitioner, is trying to grab his property by engaging miscreants and threatening him of dire consequences to vacate the property for handing over the physical possession. To that effect, information was furnished with the Officer-in-Charge, Gangnapur Police Station.

State has submitted a report wherein enquiry was conducted. There are some issues in relation to a power of attorney being executed in favour of one Nitai Ghosh who has expired. The property presently has been recorded in the name of the respondent no.4 as is reflected in the police report.

Be that as it may, the police authorities have already instituted a proceeding under Section 126 of the BNSS. Police authorities would continue to keep a strict vigil and ensure that no untoward incident results because of the strained relationship existing between the petitioner and the private respondent no.4.

With the aforesaid observations, WPA 6131 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
