Advocate for the State prepared by the concerned officer of Haldia P.S. in connection with Haldia P.S. Case No. 108 of 2018 dated 2.9.2018 under sections 406/420 of the IPC.
Let such report which is enclosed along with the statement and the declaration be kept with the record. The contents of the said statement and the declaration reflect that the petitioner and the private opposite party has amicably settled the dispute. Having regard to the relationship between the parties as submitted by the ld. Advocate for the petitioner and the o.p., the contents of the statement which has been further recorded by the officer of the Haldia P.S. as also the declaration, I am of the view that further continuance of the
proceedings of Haldia P.S. Case No. 108 of 2018 dated 2.9.2018 including the charge-sheet submitted therein is unwarranted, as the parties have amicably settled the dispute and the nature of the dispute are amongst the relations (father and the son).
Accordingly, all further proceedings of Haldia P.S. Case No. 108 of 2018 dated 2.9.2018 under sections 406/420 of the IPC pending before the ld. ACJM, Haldia including the charge-sheet submitted therein, is hereby quashed.
Warrant of arrest, if any pending, be recalled. With the aforesaid observations, CRR 992 of 2024 is allowed.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
