Mr. Subhasish Pachhal ...for the petitioner Mr. Sujit Sankar Koley ...for WBSEDCL Mr. Tapas Kumar Adhikari Mr. Indrajit Ghosh ...for the State The petitioner contends that a high-tension cable wire has been laid over his land, and a pole has been installed therein without his consent by the West Bengal State Electricity Distribution Company Limited (WBSEDCL).

Learned counsel for WBSEDCL, however, submits that the electric cable was realigned as part of a project undertaken by the Public Health Engineering Department of the State to widen the public road. During the implementation of this project, an inspection was conducted, and based on the inspection, a pole was installed on a common passage.

The petitioner, however, maintains that the relevant pole has been installed on a plot of land that he owns.

In light of the nature of the dispute, it is deemed appropriate to grant liberty to the petitioner to file a representation before the concerned District Magistrate within two weeks from the date of this order.

If such a representation is made, the District Magistrate shall consider it in accordance with Proviso 3(b) of the Work of Licensees Rules, 2006, within one month from the date of the representation. In deciding the representation, the District Magistrate shall hear the petitioner, the representative of WBSEDCL, and the concerned officials of the Public Health Engineering Department of the State. A decision will be communicated to all parties involved.

Accordingly, WPA 6134 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
