Present petition has been field with the following prayer:- a) Writ in the nature of mandamus commanding the respondents, there men and agents and the subordinates to showcause as to why vehicle bearing no WB-41J-8993 (Burnt Vehicle) is being replaced by vehicle registration non WB41M-6916 (New Vehicle) immediately by the respondent no 04.

b) Writ in the nature of mandamus commanding the respondents, there men and agents and the subordinates to showcause as to why certificate of cancellation of the registration the vehicle bearing no WB-41J-8993 (Burnt

Vehicle) has not been issued by the respondent 07.

c) A writ in the certiorari calling upon the respondents to produce all the records pertaining to the case before this Hon'ble court so that conscionable Justice may be done.

d) Rule Nisi in terms of prayer (a), (b) and (c) above. Rule be made absolute, should be fail to showcause or sufficient cause.

e) Any other further order or orders, direction or directions as to Your Lordships may deem fit and proper.

Learned counsel for the petitioner submits that the petitioner was granted permanent stage carriage permit P.st.P no. WB2022-SC-0188A for the route Kolkata Station to Rajgir and vehicle bearing no. WB41J-8993 was endorsed in the said vehicle. Learned counsel submits that the vehicle no. WB-41J-8993 was torched by furious mob for which the petitioner made an application dated 26th July, 2023 for replacement of vehicle pursuant to which the petitioner purchase the vehicle bearing no. WB-41M6916. The petitioner vide letter dated 27th May 2025 submitted the requisite documents, however, the concerned office of STA has not endorsed the replace vehicle in the said permit. The petitioner sent a

communication to the Chairman and the Secretary, State Transport Authority, West Bengal and the Joint Secretary, State Transport Authority, West Bengal dated 4th August, 2025 praying the replacement of his vehicle under the said permit. However, no decision has been taken in this regard.

Learned counsel for the respondent no. 8 and 9 appears and states on instruction that the petitioner has not served any notice or made nay representation to respondent nos. 8 and 9 in this regard.

Upon hearing of the parties, this Court is of the opinion, let respondent nos. 1 to 7 consider and decide the communication dated 4th August, 2025 by a reasoned order after giving the parties an opportunity of being heard. The communication dated 4th August, 2025 within 10 weeks from the date of communication of this order. Respondent nos. 8 and 9 may also consider the present writ petition as a representation and take the necessary decision within 10 weeks from the date of communication of this order. The concerned authority shall inform the petitioner, the order within one week of the passing of the order.

WPA 6412 of 2026 stands disposed of.
