Mr. Santanu Maji Mr. Bhaskar Banerjee Mr. Subhayu Das .....for the petitioner This is an application seeking an expeditious disposal of a proceeding under Section 125 of the Code of Criminal Procedure.
Learned counsel for the petitioner submits as follows. The petitioner got married to the opposite party in 2011. A male child was born in 2012. Thereafter, the petitioner was physically and mentally tortured by the husband and other in-laws and driven out from the matrimonial home with the minor child. In 2013 the petitioner filed an application under Section 125 of the Code and monthly interim maintenance was granted to the petitioner and her minor child at the rate of Rs. 7,000/- and Rs. 4,000/- respectively. However, in the meantime, the main proceeding has remained pending for no fault of the present petitioner.
I have heard submissions of the learned counsel appearing on behalf of the petitioner and have perused the revision petition.
No prejudice will be caused to any one if a direction be passed for expediting the proceeding.
An application under Section 125 of the Code that was filed in 2013 ought to have been concluded by now.
In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of six months of the next date of hearing.
With these observations, the revisional application is disposed of.
