Roy, Ms. Sonal Agarwal, Ms. Antalina Guha ... for the respondent Bank Mr. Suhrid Sur ... for the respondent no. 5 Learned counsel for the petitioner submits that the outstanding amount of Rs. 3.66 lakhs was made to the Bank on 28th April, 2023. The petitioner has filed an affidavit to that effect in Court today. Paragraph 7 of the said affidavit states that the petitioner has paid a sum of Rs. 3,66,000/- to the Bank by way of RTGS/NEFT on 28th April, 2023. Proof of payment is enclosed with the affidavit. The declaration/undertaking of the petitioner has also been made by way of an affidavit, which is filed in Court today.
Learned counsel appearing for the respondent Bank acknowledges the receipt of the said amount. Since the entire amount outstanding in the name of the petitioner has now been paid to the Bank and is to the satisfaction of the Bank, nothing further remains to be adjudicated in the writ petition and the petitioner must be held free to return to Kuwait where the petitioner resides.
WPA 6270 of 2023 is accordingly disposed of with a direction on the respondent Bank to withdraw the Look Out Circular within 48 hours from date. The Bank shall give an intimation of the same to the petitioner by 4.30 p.m. by 3rd May, 2023. The petitioner shall be free to return to Kuwait since the petitioner receives the intimation as directed from the Bank.
