1. Learned advocate appearing for the petitioner submits that the petitioner was employed at a branch office at Bankura as Area Sales Manager. Learned advocate further submits that the petitioner is aged over 60 years and after retirement from his original job, joined the company where he was assigned. He also submits that petitioner is in custody for about seven months. The charge-sheet has been submitted, charges have been framed and examination of witnesses is about to commence.
2. Learned advocate for the State opposes the prayer for bail and submits that apart from the salary, the petitioner received Rs. 2-5 lakhs as incentives for the sales, in respect of the money which was collected from the people of Bankura and deposited to the account of the company.
3. I find that Swaroop Dutta, another accused, who is the Chief Operating Officer, has been granted bail on 15th October, 2025. The case is presently based on documents. Having regard to the period of detention and the fact that charges have already been framed, I am of the opinion that further detention of the petitioner is unwarranted.
4. Accordingly, the application for bail of the petitioner is allowed.
5. As such, the petitioner shall furnish a bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000/- (Rupees Ten Thousand only) each, one of whom must be a local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat.
6. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court in seisin of the case. The petitioner shall not leave the district of North 24-Parganas without prior permission of the concerned Court.
7. Accordingly, C.R.M. (M) 698 of 2026 is disposed of.
8. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
9. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
