The writ petition is misconceived.
The petitioner alleges that certain antisocial elements have been disturbing the smooth functioning of an ICDS centre situated on the land of the petitioner. The only connection of the petitioner with such centre is that the petitioner had donated a part of his land for construction of the same.
There are no allegations against the authorities. There are no allegations that the authorities had either acted contrary to law or had not performed their functions properly. The only allegation is disturbance by some antisocial elements. There is no police complaint. Under such circumstances, the Court does not find any reason to issue a mandamus upon the respondent authorities on the mere apprehension of the petitioner that the authorities would support the antisocials and shift the ICDS centre to another locality.
Even if the authorities decide to take any administrative decision to shift the ICDS centre, the petitioner cannot prevent the same. Neither this Court nor
the authority can interfere with any decision of the administration.
Accordingly, the writ petition is disposed of without any orders.
If there are any private disputes, the petitioner can approach the appropriate forum in accordance with law. However, there will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
