The petitioners seek refixation of the pay-scale as per the communication of the Joint Secretary, Government of West Bengal dated 17th February, 2023 annexed at P/7 to the writ petition. The Joint Secretary appears to have issued several clarifications for scrutinizing post retiral cases under ROPA, 2019. The petitioners, who are in service claim that, based on the clarifications and illustrations annexed thereto, they are also entitled to revision of their pay scale w.e.f. 2009.

In that view of the matter, the District Inspector of School, (P.E.), Paschim Medinipur shall take a decision in the matter within a period of two months from the date of communication of this copy of this order along with the copy of the writ petition.

The petitioners may be called upon, if necessary, by the District Inspector of Schools to produce any relevant records.

4. Any decision taken by the District Inspector of Schools, as directed above, shall be communicated to the petitioners immediately thereafter.

5. With these observations, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.
