1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a Government contractor. He was granted a contract by the Egra Municipality to construct a market complex. The entire process was transparent. A public notice was issued. Bids were invited. There were seven bidders and the petitioner was the highest bidder amongst them. It was thereafter that the petitioner was given the contract. The petitioner continues to make payment of the lease rent. The principal accused, being the Chairman of the Municipality, was arrested and was thereafter granted bail.
2. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that there was a collusion between the petitioner
and the Chairman in getting such tender. The property was valued much higher. Yet, a small sum of Rs.1 lakh was taken as yearly lease rent. Even the property had not been converted for such purpose.

Considering the above, the other materials available in the case diary, the fact that the tender was granted in favour of the petitioner in 2023 after he was found to be the highest bidder pursuant to publication of notice in this regard and the fact that the principal accused was arrested and was thereafter granted bail, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the I.O once a week till submission of report in final form.
5. Accordingly, the application for anticipatory bail is allowed.
6. The personal appearance of the Investigating Officer is noted and is dispensed with.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
