Learned Counsel for the petitioner submits he is not the owner of the shop where illicit liquor was sold. He has been falsely implicated. He is in custody for more than a year. He prays for bail.

Learned Counsel for the State opposes the bail prayer and submits twelve persons died due to consumption of illicit liquor. Trial is in progress.

We have considered the materials on record. Offence involves death of twelve persons due to consumption of illicit liquor. Trial is in progress. Seventeen witnesses have been examined. Prosecution assures this Court that remaining witnesses shall be examined shortly. In view of nature of the

offence and as trial has substantially progressed, we are not inclined to grant bail to the petitioner at this stage

4. Application for bail is, thus, rejected.
