Petitioner insists that the permission which was granted for an approach road and culvert by the Executive Engineer, Midnapore Division, PWD could not be given effect to as the private respondents raised objection and the police authorities did not assist and/or maintain the law and order.

Earlier, by an order dated 02.04.2025, a direction was passed for submission of a report from the Officer-in-Charge, Belda Police Station. However, since there was an urgency of the petitioner, petitioner intended to get the matter heard, out of turn.

In view of the subject matter involved in the writ petition where the PWD Authorities have also not been made a party and the grievance of the petitioner is that the order passed by the PWD Authorities

cannot be implemented, I am of the opinion that the police authorities will give effect to an order of an executive only if there is a direction upon the police authorities by the executive concerned.

Having regard to the same, I am of the view that the petitioner will approach the Executive Engineer for necessary direction upon the police authorities. If any direction is passed by the concerned Executive Engineer or his higher authorities then only the police authorities will act. Accordingly, no interference is called for by this Court.

WPA 6195 of 2025 is, thus, disposed of.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
