Sourav Mondal v. State Of West Bengal
22.05.2025 Ct.No.34 b.das Rejected C.R.M. (DB) 981 of 2025 In Re : An application for bail under Section 483 of BNSS, 2023 filed in connection with Narendrapur Police Station Case No.1002 of 2019 dated 30.07.2019 under Sections 457/458/460/392/201/411/34 of the Indian Penal Code. And In Re :
Sourav Mondal ... Petitioner.
Mr. Angshuman Chakraborty Mr. S. S. Saha ... for the petitioner.
Mr. Madhusudan Sur Mr. S. Basu Roy Chowdhury ... for the State. Heard learned counsels for the parties.
The petitioner is in custody for more than 4 years and renews his prayer for bail.
Learned counsel for the petitioner submits that trial is progressing at a very slow pace and chance of completion of trial in near future is almost impossible.
Learned counsel for the State opposes the prayer. Learned counsel for the State submits that the prosecution proposes to examine 15 more witnesses. The petitioner's prayer for bail was turned down earlier upon consideration of the material on record. The petitioner prima facie appears to be the assailant who caused the death of the two caretakers of the property in question. The FSL and the serological report support the prosecution case. Considering the material on record prima facie connecting the petitioner to the alleged murder, prayer for bail is rejected at this stage.
However, the learned trial Court is directed to take necessary steps for expeditious disposal of the matter without granting any unnecessary adjournment to either of the parties, in accordance with law.
The application for bail is thus disposed of. Case diary be returned.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
