By this revisional application the plaintiff/husband prays for expeditious disposal of Matrimonial Suit No.315 of 2005 pending before the learned Additional District Judge, Contai, Purba Medinipur.

It is submitted by the learned Advocate for the petitioner that two interlocutory applications are pending before the learned Court below; one for early disposal of the suit and the other for modification of the order of maintenance. It is submitted that the maintenance, as directed by the learned Court below, is being paid.

Under such circumstances, this revisional application is disposed of with a direction upon the learned Court below to dispose of the pending applications within a period of two months from the next date fixed upon allowing the opposite party to contest the same.

Upon disposal of the aforementioned applications, the learned Court below shall

dispose of the suit expeditiously preferably within one year thereafter.

It goes without saying that if the maintenance, as directed by the Court, is not paid, then the learned Court below shall proceed in accordance with law and will not be bound by this order.

This Court has not gone into the merits of the case and the learned Court below shall proceed on the merits of the applications and the suit and adjudicate the same in accordance with law.

It is also made clear that unnecessary adjournments shall not be granted to either of the parties. The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application upon the opposite party/wife along with a server copy of this order immediately.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
