The writ application has been preferred alleging illegal and unauthorized construction on the premises No. 36/1, Pottery Road, Police Station Entally, Kolkata-700015 by the private respondent.

Inspite of service, the private respondent has not appeared today. The Kolkata Municipal Corporation is being represented.

It is submitted by the learned counsel appearing for the petitioner that a complaint to the Officer-in-Charge, Entally Police Station was made by the petitioner regarding such illegal and unauthorized construction and also through her learned counsel to the Executive Engineer, Kolkata Municipal Corporation in the year 18.02.2020 but till date, neither any inspection has been conducted nor any steps has been taken subject to the said representation dated 18.02.2020.

On hearing learned counsels for the parties, the writ application is disposed of with a direction that the Kolkata Municipal Corporation shall consider and dispose of the representation dated 18.02.2020 filed by the petitioner within 60 days from the date of communication of this order.

On hearing the parties and on conducting an inspection, the Kolkata Municipal Corporation shall pass a reasoned order. In case, the copy of the representation dated 18.02.2020 is not available with the authority concerned, a copy of the same shall be filed by the petitioner within 7 days from the date of communication of this order and the matter shall be considered within 60 days thereafter.

Consequently, pending applications, if any, stand disposed of.

Interim order, if any, stands vacated.

There will be no order as to costs.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Shampa Dutt (Paul), J.)
