A note has been forwarded by the Sub Assistant Engineer, Assistant Engineer and one Mr. Tushar Kanti Goswami signed on 10th May, 2023 wherein it has been mentioned that a spot inspection was conducted on 8th May, 2023 with prior intimation to both the parties. It revealed that there was an existing water supply line at the residence of the petitioner. There is existence of water supply line at the premises of the private respondents also.

To find out an alternative way through which the water connection may be supplied to the petitioner's place the parties were requested to show a mutually

agreed place. None of the parties were able to show any mutually agreed alternative path through which water connection may be affected in the petitioner's portion. That being the situation, the Durgapur Municipal Corporation is restrained from disconnecting the water supply line of the petitioner.

In the event, any mutually agreed alternative path is brought to the knowledge of the Durgapur Municipal Corporation then necessary steps will be taken in the matter after giving notice to all the necessary parties.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
