Samiul Haque Mr. Raunak Shaw ... for the petitioner This application under Section 24 of the Code of Civil Procedure is at the instance of the father of a minor son praying for transfer of Misc. Act VIII No. 235 of 2015 presently pending before the learned Additional District Judge, 1st Court at Barasat, North 24 Parganas.

The petitioner claims to be a resident of Salt Lake. It has been stated in the said application that various criminal proceedings are pending before the Sealdah court and since the petitioner resides in Salt Lake it is difficult for him to go to Barasat court for the visitation.

Considering the fact that the petitioner is the resident of Sealdah this Court is not inclined to entertain the prayer for transfer of the Act VIII case from Barasat court to Sealdah.

At this stage, learned advocate appearing for the petitioner submits that the learned Additional District Judge, 1st Court at Barasat is flooded with

cases arising out of offences related to persons falling under Scheduled Caste and Scheduled Tribe category.

In the light of the said submission, C.O. 960 of 2025 is disposed of by giving liberty to the petitioner to approach the learned District Judge, 24 Parganas (North) at Barasat with a prayer for transfer of the case to any one of the other Additional District Judge.

No order as to costs.
